I. Overview

To build a safe and trustworthy e-commerce environment on Fanno and provide positive experience to merchants and consumers, in accordance with relevant laws and regulations, Fanno Intellectual Property Policy (hereinafter "Fanno Intellectual Property Policy" or "this policy") is specially formulated.

This policy applies to provide general information about intellectual property (IP) rights and common IP concerns that might arise for merchants and customers in this jurisdiction.

Fanno is dedicated to protecting Intellectual Property (IP) Rights and we do not allow listings and contents that violate the intellectual property rights of brands or other rights owners, including trademarks, copyright and other intellectual property rights. Violating this policy may result in loss of selling privileges or other legal consequences. If you are unsure whether the material you plan to report to us is infringing or otherwise violating another person’s right, you may also want to seek legal advice.

Fanno Intellectual Property Policy is updated periodically. Please check this page often to ensure that you are always up to date with our latest policy.

Nothing in this Fanno Intellectual Property Policy is intended to limit or exclude any mandatory provisions of local law applicable in your jurisdiction.

II. Definition

Intellectual property, or IP as it is commonly referred to, consists of all the intangible creations of human intellect, such as inventions; literary and artistic works; designs; symbols, names and images used in commerce.

The three major types of protections available to IP include:

A trademark is a word, symbol, slogan, design, or combination of any of the foregoing that identifies the source of a product or service and distinguishes it from other products or services.

Copyright is a legal right that protects original works of authorship (e.g., books, films, music, videos, computer programs, etc.). Generally, copyright protects an original expression of an idea (e.g., the specific way a video or music is expressed or created) but does not protect underlying ideas or facts.

3. Patent

A patent for an invention is the grant of a property right to owner, issued by competent authorities of each jurisdiction. The right conferred by the patent grant is the right to exclude others from making, using, offering for sale, or selling the invention in the specific jurisdiction that the patent is granted or importing the invention into such jurisdiction.

III. IP Infringement Complaint

If you are a rights holder who wishes to file a complaint in relation to products or other content offered by traders using the Fanno platform you can do so in the ways set out above. In addition, you can send to a notification to our email address at service@mail.fannoshop.com .

Note that we will only accept reports from the IP rights owner or their authorized representative.

Before submitting an IP infringement complaint, please be aware that intentionally submitting a misleading or fraudulent complaint may lead to liability for damages under local laws. If you are not sure if you are the proper IP holder or if IP laws protect the material, please contact a lawyer.

1. Complaint Preparations

1.1 Reporting Requirement

Only the IP rights owner or their authorized representative may file a report of IP infringement. If you believe something on Fanno infringes someone else’s IP rights, you may want to let the rights owner know.

Note that all information submitted in your report may be forwarded to the uploader of the content, or otherwise made public by Fanno or a third party in order to investigate your report.

Please understand that Fanno is not in a position to adjudicate disputes between third parties, and may not be able to take down the product / content you reported. You may want to contact the entity / individual user who listed the product / posted the content or owners the accounts to try to resolve your issue directly.

All complaints should provide the information requested in our Reporting materials. We may provide the account holder with your contact information, including the email address and the name of the IP owner, and/or details of the complaint.

Please be aware that if your submitted information does not meet the requirements, you will receive an email requesting supplementary materials. Only when your submitted materials meet all the requirements can you file a complaint.

IV. IP Infringement Counter-Notification

1. Counter-notification Process

If you receive an IP infringement notification that you believe to be in error or believe that you are authorized to use the product/content, you can reach out to the IP rights owner directly to request a retraction.

You may also file a counter-notification with us via our email (service@mail.fannoshop.com ). All complaints should include the information requested in our Counter-notification materials. Failing to include necessary information may limit our ability to deal with your claims and may result in your complaint being denied.

The counter-notification process takes time to complete, so please be patient. During this time, the IP right claimant may file an action seeking a court order to keep the content down in pursuant of local laws. Please note that we will forward the entire counter-notification to the original reporter, including any contact information you provide, in accordance with our Terms of Use and Privacy Policy. The claimant may use this information to file a lawsuit against you.

If we do not receive a notice that the original reporter is seeking a court order to prevent further infringement of the material at issue, we may replace or cease disabling access to the material that was removed if the material does not infringe any third-party IP right. The decision to re-post any material is at Fanno’s sole discretion.
